ANC 8(a) Sole Source

CPTS is currently eligible for 8(a) direct award. The following items describe the contracting benefits that an ANC-owned 8(a) firm offers its government clients. One of those benefits include the ability of the federal government to award a sole source contract to an ANC owned 8(a) company up to $22M without Justification and Approval (J&A).

Direct Award of Contract of Any Size
13 CFR 124.506(b), 13 CFR 124.506(b): FAR 19.808-1
ANC-owned 8(a)s are exempt from the $4M ceiling for direct awards and there is no statutory or regulatory requirement that prohibit 8(a) direct awards above any specific dollar amount. For contracts over $22M, a contracting officer simply justifies the award, with approval at the proper level.
No Award Protest
3 CFR 124.517(a)
The eligibility of a participant for a direct negotiated or competitive 8(a) requirement may not be challenged by another participant or any other party, either to SBA or any administrative forum as part of a bid or other contract protest.

Key ANC Benefits

  • Initial awards below $22M don't require a J/A.
  • The acquisition process for an ANC sole source is extremely fast to support time sensitive requirements.
  • An ANC sole source contract award cannot be protested (per 13 CFR 124.517)
  • Law and regulations permit open discussion between the Government and the awardee throughout all phases of the procurement. Such interactive discussion ensures complete and comprehensive understanding of Government requirements and mutual exploration of alternative approaches to solutions (per 13 CFR 124.503)
  • The utilization of ANC sole source awards give Contracting Officers the ability to create bridge or supplemental contracts while acquisition strategies are in development or funding is expiring, thus ensuring service continuity is maintained
